Welcome to KenaFeh ! These Terms of Service outline the rules and regulations for the use of our website. By accessing this website, you accept the following terms and conditions.
License to Use the Website:
Unless otherwise indicated, KenaFeh and/or its licensors own the intellectual property rights for all material on this website. You may view and/or print pages from KenaFeh .com for your own personal use subject to restrictions set in these terms and conditions.
Restrictions:
You are expressly prohibited from doing the following:- Publish any material on the website in any other media without our permission.
- Sell, sublicense and/or commercialize in any way any material on the Website.
- Use this website in a way that is harmful to the site itself.
- Use this website in any way that affects user access to this site.
- Using this website contrary to applicable laws and regulations, or in a way that may cause harm to the website, or to any person or business entity.
- Engaging in any data mining, data harvesting, data extracting or any other similar activities on this website.
1 - Premises
These terms and conditions (hereinafter “Terms”) apply to any booking and sale of Products made via the website: www.kenafeh.it, (hereinafter “Platform”).
When placing the order (as better defined below), the Customer accepts these Terms and in relation to which he is required to carefully read the contents before making the purchase on the Platform referred to in point 1);
KenaFeh's cookie and privacy policies, which can be consulted at any time on the Platform, constitute an integral part of these Terms and will be automatically accepted upon acceptance of these Terms.
2 - Acceptance
2.1. When making a booking on the Platform, the Customer confirms:
– be 18 (eighteen) years old and in possession of a debit or credit card, as well as other equivalent means that can be used for payment on the Platform
– to make purchases for personal consumption purposes;
– have the legal capacity to enter into binding agreements.
2.2. By accepting these Terms, the Customer agrees to receive all information relating to the Service offered by KenaFeh in Italian and English. The Customer also accepts that all agreements with KenaFeh and related information necessary for the performance of the Services, which will be retained by KenaFeh in accordance with the latter's privacy policy.
Furthermore, by accepting these Terms, the Customer understands that he may also receive emails and messages relating to the reservations he has made, if necessary. This is requested by KenaFeh to ensure that the Customer receives all essential communications relating to the order.
2.3. KenaFeh reserves the right to revise and modify the Terms from time to time. Your order will be governed by the Terms applicable at the time you placed your order.
3 - Product information
3.1. KenaFeh has the task of simply organizing the conclusion of the purchase between the Customer and the Supplier, therefore it is indemnified from any possible liability profile in relation to the Products.
3.2. KenaFeh does not in any way provide for the creation, preparation, production, processing, marking, packaging, delivery or management of the Products.
3.3. KenaFeh will not assume any responsibility towards the Customer for the fulfillment of the contractual obligations relating to the Products, including their creation, preparation, production, processing, delivery; similarly, it assumes no responsibility regarding compliance with the applicable legislation, even relating to the activities just listed.
3.3. KenaFeh will provide descriptions and information about the Products through the platform referred to above. This information has merely indicative value for the purpose of allowing the Customer to better evaluate the selected Products before making the purchase. It is possible that the Platform is not updated and that the actual range of products, items in stock, etc. is not the one indicated on the Platform. In this case, KenaFeh will not be responsible.
3.4 KenaFeh will not be responsible for failure to fulfill or delay in the performance of any obligation relating to the Products, including in relation to the creation, production, processing, delivery, of the Products.
4 - Confirmation of the order
4.1. KenaFeh, having received the Order, will start the processing process by sending appropriate notification to the Customer that the Order has been received ("Order Confirmation") and is being processed. This will not imply automatic acceptance of the booking by the Supplier.
4.2. The Order Confirmation must be saved by the Customer and will contain information relating to the booking made by the Customer.
4.3. The Order Confirmation does not imply acceptance of the Order, but only a confirmation of receipt of the Order.
5 - Right to complain
5.1. In the event of a complaint regarding a Product, the Customer must send an email to info@kenafeh.it, before taking any other action. KenaFeh, for its part, will handle all complaints in the way it deems most correct.
5.2. In the event that KenaFeh's intervention to handle the complaint is not satisfactory to the Customer, these Terms do not preclude the possibility for the Customer to use other means to resolve the dispute with the Supplier as established by law. The Services are governed by consumer protection legislation and other legal provisions relating to the purchase of goods (in Italy, Consumer Code); furthermore, the provisions of this document in relation to defects and delays in the performance of the Service also apply.
5.3 All complaints will be handled exclusively by KenaFeh and the Customer must address complaints to it and not to the Supplier.
The Customer is required to check the contents of the Products when he receives them.
In the event of a complaint, the Customer must contact KenaFeh via email info@kenafeh.it, providing all the requested information. KenaFeh - subsequently - will process the complaint in collaboration with the Supplier, where necessary, reserving the deadline of 10 working days to provide the Customer with a response.
6 - Reviews
The Customer's reviews on the Platform cannot, by way of example:
– contain defamatory, obscene or offensive material;
– promote violence or discrimination;
– violate the intellectual property rights of another natural or legal person;
– violate any legal obligation towards third parties (such as the obligation of confidentiality);
– promote illegal activities or invade the privacy of others;
– give the impression that they come from KenaFeh;
– be made in the name and on behalf of another person or to misrepresent your affiliation with another person.
6.2. KenaFeh will not monitor and will not modify the reviews published, except that it has the right, exercisable at any time, to remove or modify the reviews published, uploaded or transmitted via the Platform if the aforementioned violate one or more of the prohibitions set out above or if they are deemed fraudulent.
6.3 The reviews published on the Platform are for informational purposes only and do not constitute a recommendation by KenaFeh. Therefore, the reviews reflect the opinions of customers who have booked the Products using the Platform or other third parties; any statements, suggestions or opinions provided by such individuals reflect solely their thoughts. Consequently, to the extent permitted by law, KenaFeh assumes no responsibility in place of a third party who may have created a review, including, but not limited to, for errors, defamatory expressions, obscenity, omissions or false statements that the Customer can find within those reviews.
6.4. KenaFeh reserves the right to retain the reviews published on the Platform.
7 - Limitation of liability
7.1. KenaFeh will not be liable for damages resulting from the Products or matters for which the Supplier will be responsible, culpable actions attributable to third parties or resulting from an interruption, not attributable to KenaFeh or to the operation of the Platform; orders placed by Customers using payment data or other contractual data obtained fraudulently; the content of the sites to which the Platform links, including the accuracy and data protection guaranteed by such sites;
7.2 KenaFeh will not be responsible for any dysfunction or non-conformity of its Services if such circumstances are caused by events beyond KenaFeh's control. Such circumstances may be, by way of example only, interruptions in the operation of the KenaFeh Platform and/or disruptions in the activity of the Point of Sale deriving from legislation, acts of the State or public bodies, acts of war or terrorism, strikes, impediments physical, lockouts and natural disasters.
8 - Intellectual property
The Customer may use the Platform and print and download extracts from it for personal and non-commercial use based on the established criteria below:
– the Customer must not make improper use of the Platform (including hacking or "scraping").
– Unless otherwise indicated, copyright and other intellectual property rights in the Platform and material published on it (including, without limitation, photographs and graphical representations) are owned by KenaFeh or its licensors. Such works are protected by international copyright laws and treaties, and such protection extends throughout the world; furthermore, all related rights are reserved. For the purposes of these Terms, any use of extracts from the Platform is prohibited;
– the Customer may not use any image, photograph or any other graphic element, video or audio sequence without also including the accompanying text;
– The Customer guarantees to recognize and always cite KenaFeh in his capacity as author of the material present on the Platform;
– The Customer is not authorized to use any of the materials on the Platform or the Platform itself for commercial purposes without having obtained a license from KenaFeh to do so.
9 - Applicable law
These Terms (and any booking and purchase of Products made hereunder) are subject to the laws of the country in which the platform is located, where you place your order or purchase.
or relating to the same - if such dispute does not reach an amicable solution - will be decided by the courts of the country where the Customer is domiciled or resident.
Regardless of the above, the Customer can always lodge a complaint before the competent consumer protection authority in the country in which the platform where the order or purchase was made is located.
10 - Returns
10.1 The return of items is the right of KenaFeh customers, with the exception of those with personalization.
To correctly process your return, send an email to info@kenafeh.it, including your order information. All items must be returned, intact, together with their original box, where present, which is considered to all intents and purposes an integral part of the product itself and which must not have been damaged and/or altered in any way, and cannot be used as the only external packaging.
10.2 A label must be affixed containing the sender's details, the shipping address and the authorization code received. Alternatively, it is possible to hand write the required data on the packaging using a permanent marker. The goods must be complete with all their parts and in the original packaging (envelopes, boxes, dustbags and packaging), with the tags still attached.
10.4 All items must be returned together with their original box, where present, which is considered to all intents and purposes an integral part of the product itself and which must not have been damaged and/or altered in any way, and cannot be used as the only outer packaging.
10.5 The shipment, until receipt is certified in the warehouse indicated by KenaFeh, is under the complete responsibility of the customer.
10.6 KenaFeh will not be responsible if the goods are damaged during transport
10.7 KenaFeh will not be liable in any way for damage, theft or loss occurring during or in any case in connection with the return shipment. KenaFeh will reimburse the Customer for the entire amount of the returned items, within 14 (fourteen) days of receipt of the return shipment, through a cancellation procedure of the debited amount, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. In any case, the Customer will not bear any costs as a consequence of said reimbursement. KenaFeh may suspend the refund until receipt of the returned product or until the Customer demonstrates that he has correctly sent the product back. In any case, the Customer will lose the right of withdrawal in cases where KenaFeh ascertains that:
the returned product and/or its accessories, and/or its packaging are not intact;
the product is missing its external packaging and/or the original internal packaging;
the product is missing integral elements and/or accessories (e.g. closures, laces, buckles, etc.).
10.8 In the event of forfeiture of the right of withdrawal, KenaFeh will return the purchased product to the sender, charging the shipping costs and, if already refunded, the price of the product.
We specify that, if the item you want to return is defective, the return shipping costs will be covered by KenaFeh's partner brand, but not by the latter. If the item you intend to return is not faulty, then due to a change of mind or size, customers will have to cover the return shipping costs.
11 - Variation of Terms: KenaFeh is authorized to modify these terms at any time at its discretion, and by using this website you are requested to review these terms regularly.
